These Terms and Conditions ("Terms") govern the use of services provided by Stark Automate Solutions ("we", "our", "us"). By engaging our services, you ("Client", "you") agree to the following:
1. Scope of Services
Stark Automate Solutions provides business automation services, including:
- Workflow automation design and implementation
- Messaging integrations (e.g. WhatsApp and related platforms)
- System configuration and optimization
We act as a service provider and implementation partner, not as a platform owner.
2. Client Infrastructure & Accounts
Stark Automate Solutions does not own or operate messaging infrastructure or customer data platforms.
Clients agree that:
- All services are built on the Client's own accounts, systems, or third-party platforms
- The Client may grant Stark Automate Solutions access to existing systems for setup and configuration
Alternatively:
- The Client may authorize Stark Automate Solutions to create, subscribe, or configure third-party services on their behalf
All such access and authorization must be explicitly approved by the Client.
3. Authorization to Act on Behalf
Where required, the Client grants Stark Automate Solutions permission to:
- Set up and configure accounts on third-party platforms
- Subscribe to services using Client-approved details
- Manage and maintain systems on behalf of the Client
The Client retains full ownership of all accounts created.
4. Data Responsibility
Stark Automate Solutions does not store or maintain customer databases.
Clients acknowledge and agree that:
- All customer data belongs solely to the Client
- The Client is responsible for ensuring proper data handling and legal compliance
- Stark Automate Solutions may process data temporarily only as required to deliver services
5. Compliance and Acceptable Use
The Client agrees to:
- Obtain proper consent before sending messages to end users
- Comply with all applicable laws and regulations
- Follow third-party platform policies (e.g. WhatsApp policies)
The Client must NOT use the services for:
- Spam or unsolicited messaging
- Harassment or unlawful activities
- Misuse of personal data
Stark Automate Solutions reserves the right to suspend or terminate services if misuse is detected.
6. Third-Party Services
Our services rely on third-party platforms.
Clients acknowledge that:
- Platform availability, pricing, and policies are controlled by the respective providers
- Stark Automate Solutions is not responsible for downtime, restrictions, or account bans imposed by third parties
7. Fees and Payments
- Fees will be agreed upon prior to service commencement
- Third-party costs (e.g. messaging fees, subscriptions) are borne by the Client
- Payments made to Stark Automate Solutions are for service, setup, and management only
8. Support and Maintenance
Where applicable:
- Support is provided during agreed working hours (e.g. Monday–Friday, 9:00 AM – 5:00 PM)
- Ongoing maintenance or management services must be separately agreed
9. Limitation of Liability
Stark Automate Solutions shall not be liable for:
- Any indirect or consequential losses
- Business interruption due to third-party platform issues
- Loss arising from Client misuse or non-compliance
Our total liability shall not exceed the fees paid for the service.
10. Termination
Either party may terminate the service with prior notice.
Upon termination:
- Client access to systems remains under their control
- Stark Automate Solutions will cease access and management activities
11. Changes to Terms
We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms.
